PACKAGES & MENUS
1. VALIDITY
Subject always to further negotiation of the parties, the p rices quoted are in Malaysian Ringgit (“MYR”) and valid for fourteen (14) days from the date of the Customer’s confirmation in writing .
2. BOOKING FEE
Subject to the Customer’s written con firmation in the Customer’s confirmation form herein attached and payment of non-refundable fee of 10% from the total bill paid for the purpose of securing the function date , the function date shall be treated as a “tentative” basis.
3. PAYMENT TERMS
(a) Deposit
A deposit of 70% from the total bill shall be paid at least fourteen (14) days before the function date, failing which the reservation will not be secured.
(b) Balance
The balance payment shall be paid before the function date failing which Eden Catering reserves the right not to proceed with its services .
(c) Mode of Payment
Payment in Clause 3(a) and (b) above can be made via credit card, bank draft, telegraphic transfer (“TT”) or cheque in MYR and made payable to EDEN CATERING SDN BHD, which details are as follows:
(i) Bank : Maybank
(ii) Account No.: 514196105929
Customer shall forthwith to Eden Catering a copy of bank -in slip or TT transmission slip for verification purposes. Unless otherwise stated, NO CASH PAYMENTS shall be accepted by Eden Catering.
4. CANCELLATIONS/RESCHEDULE
(a) Any cancellations must be notified in writing no less than seven (7) days before
the function date for a full refund of the deposit .
(b) Cancellations done less than seven (7) days from the function date the deposit shall be deemed as non-refundable deposit.
(c) If the Customer reschedules the event within seven (7) days prior to the function date, subject always to the availability, the deposit in Clause 3(a) shall be transferred to that new date, otherwise, the deposit is non -refundable.
5. CHANGES IN MENU OR NUMBER OF GUEST
(a) Any changes must be notified in writing no less than three (3) days prior to the function date.
(b) Changes resulting in additional cost require s a 70% deposit payment if requested in writing at least seven (7) days before the function date, or 100% if requested in writing less than seven (7) days from the function date.
(c) Changes notified in writing and to be agreed upon by both parties less than three
(3) days before the function date cannot be guaranteed. However, Eden Catering will try its best endeavor to accommodate such changes.
(d) In the event that the minimum numbers of pax cannot be met, a surcharge of RM10.00 will be charged for every pax catered for. The minimum numbers depend on the guidelines provided by Eden Catering.
6. MENU AND PRICES
Due to seasonality and/or availability of products, menu items and pricing are subject to change without prior notice.
7. OPEN-DATED RESERVATIONS
A reservation is only secured once the function date is determined and the deposit payment paid. Eden Catering reserves the right not to accept the function if there is a prior secured reservation on the given date.
8. OBLIGATION
Eden Catering shall ensure that the food and services delivered are as per the confirmed event order that is to be signed by both Eden Catering and the customer.
9. OVERTIME
Our general service duration is for three (3) hours from the confirmed service time. Please notify us in writing within fourteen (14) days prior to the event date if the function is expected to last beyond the agreed period to enable us to make the necessary arrangements and our overtime rates shall apply. The overtime rates shall also apply in the event that the notification is made during the function day .
10. HALAL
Please be reminded that we are a HALAL-certified caterer. W e appreciate your cooperation in refraining from serving food or beverages that contravene to Islamic Halal Laws.
11. INDEMNITY CLAUSE
If food or beverages sourced from caterers or suppliers other than Eden Catering is being served during the function, the Customer hereby agree to indemnify and keep Eden Catering indemnified against any lawsuit, liabilities, losses, expenses, claims or demands whatsoever made by the either the Customer itself, attending gues ts or any related person(s) known to the Customer in respect of or any manner arising from any health related dispute. A separate indemnity letter shall be signed by the Customer (in the case of Company, shall be signed by the authorised officer) and be given to Eden Catering upon acceptance of the terms and conditions herein stated.
12. GOVERNING LAW
The terms and conditions herein contained shall be governed by and construed in accordance with the laws of Malaysia and the parties irrevocably submit to the exclusive jurisdiction of the Courts of Malaysia.
13. ARBITRATION
Unless amicably resolved by the parties through their mutual consultation, any dispute, disagreement or difference which may arise between the parties, arising out or in relation to or in connection with the terms and conditions herein stated or the breach thereof, shall be settled through an arbitration at the Asian International Arbitration Centre (formerly known as the Kuala Lumpur Regional for Arbitration Centre).
14. GOVERNMENT CUSTOMERS (if applicable)
A government local order is required to secure reservations from all government Customers.
15. TAXES
All rates quoted in the above are in MYR, and are subject to ten percent (10%) service charge unless agreed otherwise.
16. SALES AND SERVICE TAX
The quoted rates are based on the current government taxation policy. Eden Catering reserves the right to amend the rates to ref lect new tax rates accordingly.
17. DISCLAIMER
Eden Catering shall neither be held responsible for any illness, death, injury, damage or loss prior to, during or after the event.
18. FORCE MAJEURE
Eden Catering shall not be held responsible for failure to execute obligations specified herein directly or indirectly occasioned by or through or in consequence of war, change of statues of the Government, strikes, riots, terrorism, acts of God and unforeseeable obstructions of passable roads and bridges.
